Terms and conditions
Cenit · Web dashboard and company features
The short version. These terms cover Cenit's web dashboard, at cenit.hrvojematosic.com, and the app's company features: linking devices, Projects, the team and the links for customers.
Your customers' data belongs to your company, and you're the one who must have their permission. I keep it for you and don't use it for anything of my own. I do my best to keep everything working, but I can't promise it's always up, and the inverter clouds belong to others. Plans are paid through the App Store or Google Play.
By creating a dashboard account, or linking the app to it, you accept these terms. If you use the app alone for your home, you don't need an account: the privacy policy, the rules of the store you got it from and, if you buy a plan, the plans section apply to you.
This is a translation. If it differs from the Spanish version, the Spanish one governs.
1. Who provides the service
Hrvoje Matosic, independent developer, at Av. División del Norte 1354, Mexico City. You can write to me at privacidad@hrvojematosic.com.
Here “I” means me, “you” means whoever uses the dashboard or the app, and “your company” means the installer company you sign in to the dashboard with.
2. Who can use it
- Adults who can enter into an agreement on their own.
- If you sign in on behalf of a company, you're telling me you can act for it, and the company is bound by these terms.
- A company's customers only get into what that company shares with them.
3. Accounts and roles in a company
Dashboard sign-in is handled by Clerk, with your email and a password or a code. Look after your access and don't share it: each person uses their own account. What's done with your account is on you. If you think someone got in, change your password and write to me.
Whoever creates the company on the dashboard becomes its administrator. There are three roles.
| Role | What it can do |
|---|---|
| Administrator | Everything in the company. Invites and removes people, removes projects, hands out tasks and decides which customer sees which plant. |
| Technician | Sees and works on every plant and every project, amounts included. Links their phone. |
| Customer | Sees, read only, the plants an administrator added their email to. |
Your company decides who it lets in. Choose carefully: a technician sees all of your customers' data. When you remove someone, their phone stops syncing, but what it had already downloaded stays on that phone until they delete the app or link it to another company.
A device links to the company with a six-letter code made on the dashboard. From then on it sends and receives what the privacy policy describes.
4. Your customers' data
For the personal data of your customers that you record in Cenit (name, phone, email, address, quotes, payments, CFE paperwork documents and photos, installed equipment), your company is the controller (responsable) under Mexico's Federal Law on the Protection of Personal Data Held by Private Parties. I'm its processor (encargado).
It's up to your company to
- have its own privacy notice and give it to its customers, telling them it uses Cenit to keep their data
- have their consent where the law requires it, and express consent for their financial or property details, like payments, bills or deeds
- record only what the job needs, and not upload sensitive data
- handle its customers' requests to see, correct or delete their data
As the processor, it's up to me to
- handle that data only to provide the service and as your company decides when it uses the dashboard
- not use it for anything of my own, not sell it and not hand it to anyone, except the providers listed in the privacy policy or a competent authority that asks for it under the law
- keep it carefully: everything travels encrypted, each company only sees its own, and backups are encrypted
- tell your company without delay if something compromises its data
- pass on to your company, and help it handle, any of its customers' requests that reach me
- delete that data when your company asks or closes its account, except what the law requires me to keep
5. Inverter clouds
The app connects to each brand's cloud straight from the device, with the credentials you enter, and those credentials don't reach my server. If that ever changes, it will be through a separate, optional feature, described in its own section of these terms and of the privacy policy.
Only use accounts you have the right to use: yours, or your customer's with their permission. Each brand has its own rules, and Cenit isn't connected with any of them.
6. Acceptable use
Don't use Cenit to
- do anything illegal, or keep data about people you have no right to handle
- try to get into another company's data or accounts that aren't yours, or test the server's security without my written permission
- overload the server, call it with your own programs outside the app and the dashboard, or copy data in bulk
- resell or rent out access to the dashboard
- upload viruses, harmful files or content you have no right to upload
- take Google's roof and shade data to use outside Cenit, or remove the note that it comes from Google
7. Plans and payments
- Up to 3 plants are free for good. For more, there are one-time and monthly plans, depending on how many plants you have. The first month every plant is open.
- Some features need a plan, like the Google roof and shade lookups and some quote options. The app tells you which.
- Google lookups are counted per month and per company: the members and every linked phone share one count, on the best plan any of them has shown. Today, the one-time plan gives 10 roofs a month, and the monthly plan 100 roofs and 30 shade maps a month. The count starts again on the 1st. What counts is what the app shows you at the time.
- Plans are bought through the App Store or Google Play, and the prices are there. Apple or Google charge, renew, cancel and refund under their own rules. A subscription is cancelled from your store account. I can't issue refunds directly.
- Today the web dashboard isn't charged separately. What a company can do there depends on the best plan bought on any of its linked phones.
- If I change a price, it doesn't touch what you already paid.
8. What I can't promise
- I do my best to keep the dashboard and the app working well, but I can't promise they'll always be available or free of errors. Sometimes they have to stop for maintenance.
- Inverter clouds belong to third parties. They can change, fail or cut access, and some aren't officially documented, so a connection can stop working for a while.
- Google may have no data for a roof, or old data.
- Sizing, expected production, savings, CFE tariffs and the comparison of what was promised against what's real are estimates. Check them before you quote. You answer for your quotes, your designs, your installation and for following the standards that apply to you.
- The CFE paperwork guide, its deadlines and what usually happens are reference information, not legal advice. Each CFE office can ask for other things.
- Alerts can arrive late or not at all. They aren't a safety system.
- I make backups, but keep your own copy of anything you can't lose. If you need a copy of your company's data, ask me.
9. Links for customers
A visit or paperwork link shows one visit or one CFE process, without an account. Anyone who has it can open it, so you decide who you send it to and you answer for that. If you remove the visit or the project, its link stops opening. If a link reaches the wrong person, write to me and I'll change it.
10. Your content and mine
What you record in Cenit belongs to you or your company. You give me only the permission needed to store it, process it, back it up and show it to whoever your company lets in, while you use the service. You answer for having the right to upload it, above all photos and documents of other people.
Cenit, the app, the dashboard, their code and their name are mine. These terms let you use them, nothing more.
11. How it ends
- You can stop using Cenit whenever you like. Unlink your devices and, to delete your account or your company's with everything in it, write to privacidad@hrvojematosic.com. For a company, an administrator has to write. Before deleting I can send you a copy, if you ask. Subscriptions are cancelled in the store.
- I can suspend or close an account that breaks these terms, puts other companies or the server at risk, or if an authority asks me to. When I can, I'll tell you first and say why.
- If I ever decide to close the dashboard, I'll announce it at least 30 days ahead and give you a way to take your company's data.
What gets deleted and when is in the privacy policy.
12. Liability
Cenit is provided as is. As far as the law allows, I'm not liable for indirect damages, lost profits, lost customers, or for failures or decisions of third parties like inverter brands, Google, Apple or CFE. Nor for decisions you make based on the app's estimates.
The most I'm liable for, in total, is what you paid for Cenit in the 12 months before the claim or $1,000 Mexican pesos, whichever is higher.
None of this limits my liability for fraud or bad faith, or the rights Mexico's Federal Consumer Protection Law gives you when it applies.
If one of your customers or anyone else makes a claim against me over data your company uploaded without the right to, or over a use of Cenit that breaks these terms, your company holds me harmless.
13. Changes to these terms
I can change these terms. When I do, I update this page and the date below. If the change is important, I'll announce it on the dashboard or in the app at least 15 days before it applies. If you keep using Cenit after that, it means you accept it. If you don't agree, you can stop using it and ask me to delete your data.
If I add a feature that needs rules of its own, I'll put them here as a new section.
14. Law and courts
These terms are governed by the federal laws of Mexico. For any dispute, we submit to the courts of Mexico City, and waive any other jurisdiction. If you're a consumer, you can also go to PROFECO, Mexico's Federal Consumer Protection Agency.
If part of these terms isn't valid, the rest still is. If this English version differs from the Spanish one, the Spanish one governs.
